TRADING TERMS FOR ALL SERVICES

• All down payments, monthly subscriptions and deposits received are non refundable after we have started working on the service you selected.
• WebEternity reserves the right to revise and amend an initial quote to a customer where needed.
• By purchasing any of our services you agree to our terms and conditions.

TERMS AND CONDITIONS FOR WEB DESIGN

(full payment option)

• Unless otherwise explicitly agreed and stated, WebEternity’s responsibility is limited to designing customers web sites and excludes the update, use, altering, maintenance, troubleshooting etc of the customer’s web site once online. WebEternity reserves the right to request additional payment to cover any or all of such work and/or to refuse to undertake such work after 12 months of purchase.
• WebEternity uses customers material e.g. text, information, photos etc to design customers web sites WebEternity is not responsible for these materials. The use of these web sites is at the visitor’s or user’s own personal risk. WebEternity does not warrant the content, accuracy or veracity of any material or other information on the customers’ web sites nor does it warrant that these web sites are free from errors, faults, viruses or other computer or data-damaging material. Descriptions of, or references to information, products, services or publications within the customers’ web sites do not constitute or imply their endorsement or recommendation in any way by WebEternity.
• Cpanel access and FTP or control panel username and passwords are available at request, however these are administrators control panel facilities and if the customer was to do any damage to the customers hosting account and/or web site then WebEternity are not responsible for this and WebEternity can charge the customer for the repair of the damage coursed.
• WebEternity can charge the customer if the customer was to edit or damage any of the work or code done by WebEternity.
• WebEternity do not have to update or add pages to your site after 12 months of the purchase date.
• If the customer purchase a £99 starter pack then WebEternity will not update or edit the pages for free and WebEternity will not under any circumstances give Cpanel access and FTP or control panel username and passwords to the web site or hosting account.

TERMS AND CONDITIONS FOR WEB DESIGN

(monthly payment option)

• Once the web site is paid for in full the customer owns the web site however if the web site is not paid for in full Webeternity holds the copyright and ownership un till payments are fully made.
• The customer is responsible for the information and contents within the customers web site whether it is paid for in full or not, any images within the web site that may be considered as breach of copyright is fully the customers responsibility as we only build the web site, it is down to the customer to make sure they do not provide us with copyrighted information.
• If the customer does not keep up monthly payments when they have chosen monthly payment option for the web site then WebEternity can take down there web site and terminate the customers account without notice and without refunds to the customer.
• Cpanel access and FTP or control panel username and passwords are available at request ONLY when paid for in full and we reserve the right to hand over this information un till the customer pays in full, however these are administrators control panel facilities and if the customer was to do any damage to the customers hosting account and/or web site then WebEternity are not responsible for this and WebEternity can charge the customer for the repair of the damage coursed.

TERMS AND CONDITIONS FOR SEO SERVICES

(both monthly and annual payment options)

• The customer is under no contract and can pull out at any time
• The customer must contact us to inform us that they wish to stop the service before there next payment is scheduled to be paid =
• No refunds of any payments made to webeternity from the customer
• No guarantees that we will get you on the first page of the search engines or within the search engines in any position
• content of the customers web site may need to be altered, webeternity holds no responsibility for the content on the customers web site and does not hold responsibility for errors or mistakes on the customers web site, its down to the customer to maintain the web site
• When the customer purchases our seo service we will give the customer an option to provide us with relevant login details to perform our service if the customer gives us the login details then we may access the customers web site without notice and make changes without permission in order to successfully perform our service, if the customer does not give us the login details then the customer is responsible for uploading the information onto there site.
• Webeternity will need access to the customers web site, FTP and control panel and may store the password and username for future reference unless otherwise requested on data storage that is in no way vulnerable to attack from hackers or malicious activity, the data storage will not be connected to the internet on a permanent bases and will be secure.

EXTRA TERM AND CONDITIONS (applies for all services)

• We charge a client for our time rather than the design or service, we estimate quotes and charge depending on how many hours has been spent on the clients prodject or ow many hours will be needed to finish the clients prodject.
•  It is very rare that we drop a clients project however we will do under extreme circumstances. We will never drop a project unless:

1. A member of staff at WebEternity receives abuse, threats, racism or any form of threatening or abusive behaviour from a client or potential client. This can also be followed rapidly with IP blocking and banned from our entire range of domains and services. Legal actions may be taken and clients ISP will be notified. All online activities are recorded including phone call for staff training purposes, however we hold the write to use this as evidence in a court.
2. If WebEternity have not had contact from a client for more than 6 months and the project is not finished we can drop the project whether paid for or not
3. If the client has not paid for the service we have provided for more than two weeks. This applies for finished and unfinished projects.
4. If we feel as thou the project is taking too long we will do a revaluation on the price originally given and present it to the client, if the client refuses the new price quote we will refer them to one of our associates who will continue the project.

• If a client has purchased a website with fee updating for 12 months, WebEternity will update basic content for free at request within 24 hours, however large amounts of updates can be charged for and webeternity can back list lardge amounts of updating, this includes products in a online shop. If clients have allot of updates that need doing and that they have requested for free we can do one of the following:

1. If there is a member of staff free then the large updates can and will be carried out free of charge
2. If there are no staff free or webeternity are very busy at the time, then we can back list the large updates or add it to the list of “things to do” but will not get a high priority and with no guarantee of when they will be complete
3. Client can offer payment for the time needed for the update to get a higher priority, or we may ask for an additional charge for the amount of time needed, discounted price will be given and updates will be started within 24 hours.

• Payment on Subscription - Cancelling The payments must be done by the client as we do not have access to the clients bank or PayPal accounts, however we will assist in canceling the payments in PayPal with a tutorial in our video tutorial section, with bank subscriptions via standing order the client only has to call the bank to stop payments to WebEternity. If the clients has paid for there website in full when paying on the monthly option and we recive a payment then the client can request a refund of the payment sent in error however if the client has not paid in full and decides to stop there subscription and we recive a payment and the client asks for a refund of that payment we do not have to give a refund as an outstanding bill is due.

EXCLUSION OF LIABILITY

To the maximum extent permitted by law WebEternity excludes liability for any loss, claim, damages or any special, consequential, exemplary or punitive damages (whether directly or indirectly incurred) of any kind arising out of or in connection with any visitor’s or user’s access to, or use of the Web site, or any material thereon, whether based in contract, tort or whether negligent or otherwise, even if the Company has been advised of the possibility of such damage.
